1. Introduction

Welcome to SwedDrive Insurance. These Terms of Service ("Terms") govern your access to and use of the SwedDrive Insurance website, services, and applications (collectively, the "Services").   • Constitutes unauthorized or unsolicited advertising, promotional materials, junk mail, spam, chain letters, or any other form of solicitation

4.5 Removal of Content

We reserve the right, but not the obligation, to monitor, review, and remove any User Content, at our sole discretion and without notice, for any reason, including violation of these Terms.

5. Insurance Services

5.1 Insurance Information

The insurance information provided on our website is for general informational purposes only and is not a substitute for professional advice. Insurance products and services are subject to terms, conditions, and exclusions not described on our website. Please refer to the specific policy documentation for complete information.

5.2 Insurance Applications

When you submit an application for insurance through our Services, you represent and warrant that all information provided is accurate, complete, and up-to-date. You understand that providing false or incomplete information may result in denial of your application, cancellation of your policy, or denial of claims.

5.3 Policy Issuance

The submission of an insurance application does not guarantee the issuance of a policy. All applications are subject to underwriting review and approval. We reserve the right to decline any application at our sole discretion.

If you purchase an insurance policy, you agree to pay all premiums when due. Failure to pay premiums may result in cancellation of your policy according to its terms and applicable law.

If you purchase an insurance policy, you will receive policy documents that define the specific terms, conditions, limitations, and exclusions of your coverage. The policy documents, not the descriptions on our website, constitute the legal agreement between you and the insurance company.

6. Payments and Billing

We accept various payment methods as indicated on our website. You represent and warrant that you have the legal right to use any payment method you provide in connection with our Services.

If you believe you have been billed incorrectly, you must notify us within 90 days of the billing date. After 90 days, you waive the right to dispute such charges.

For subscription services or insurance policies with recurring payments, you agree that we may automatically bill your payment method at the beginning of each billing period. You authorize us to store your payment information for this purpose.

6.5 Refunds

The SwedDrive Insurance name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SwedDrive Insurance or its affiliates or licensors. You may not use these marks without our prior written permission.

7.2 Copyright

All content on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of SwedDrive Insurance or its content suppliers and is protected by Swedish and international copyright laws.

7.3 DMCA Compliance

If you believe that content on our Services infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our copyright agent with the following information in writing:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest

  • A description of where the material that you claim is infringing is located on the Services

SWEDDRIVE INSURANCE AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NEITHER SWEDDRIVE INSURANCE NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE SERVICES WILL BE ERROR FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED.

WHILE WE STRIVE TO PROVIDE ACCURATE INFORMATION ABOUT INSURANCE PRODUCTS AND SERVICES, WE DO NOT WARRANT THAT THE DESCRIPTIONS OR OTHER CONTENT ON THE SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.

9. Limitation of Liability

IN NO EVENT WILL SWEDDRIVE INSURANCE, OR ITS SUPPLIERS OR LICENSORS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THESE TERMS UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR: (I) ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; (II) THE COST OF PROCUREMENT FOR SUBSTITUTE PRODUCTS OR SERVICES; (III) FOR INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA; OR (IV) FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU TO SWEDDRIVE INSURANCE UNDER THESE TERMS DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION. SWEDDRIVE INSURANCE SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL.

THE FOREGOING SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

10. Indemnification

You agree to indemnify and hold harmless SwedDrive Insurance, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Services, including but not limited to your violation of these Terms.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without giving effect to any principles of conflicts of law.

11.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Stockholm, Sweden in accordance with the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce. The language of the arbitration shall be English.

11.3 Small Claims

Notwithstanding the foregoing, either party may bring an individual action in small claims court.

11.4 Injunctive Relief

Notwithstanding the foregoing, SwedDrive Insurance may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on our website and updating the "Last updated" date. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.

13. General Terms

13.1 Entire Agreement

These Terms constitute the entire agreement between you and SwedDrive Insurance regarding your use of the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning their subject matter.

13.2 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

13.3 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court or other tribunal of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall not be affected.

13.4 Assignment

You may not assign these Terms or any rights or obligations hereunder without our prior written consent, and any attempt to do so without such consent shall be void. We may assign these Terms or any rights or obligations hereunder without your consent.
